Welcome and Acceptance of Terms
Welcome to Fitzi.ai, a Growith company. Fitzi.ai is operated by GROWITH LLC, headquartered at 8600 Freeport Pkwy, Ste 130, Irving, TX 75063.
By using Fitzi.ai’s AI-powered marketing services and automation tools (“Services”), you agree to these Terms of Use (“Terms”). If you do not agree, please discontinue use immediately.
Description of Services
Fitzi.ai provides artificial intelligence–driven marketing automation solutions, including campaign generation, customer insights, analytics, and optimization tools.
We may integrate with third-party applications (such as ad networks, CRMs, or payment systems). By using our Services, you also agree to any applicable third-party terms.
User Conduct & Community Guidelines
When using Fitzi.ai, you agree not to:
- Use the Services for illegal, abusive, or fraudulent purposes
- Interfere with or attempt to disrupt the platform’s functionality.
- Misuse AI tools to generate harmful, misleading, or discriminatory content.
- Reverse-engineer or resell any proprietary software components.
Violation of these rules may result in suspension or termination of your access.
Account and Responsibilities
You must provide accurate registration details and maintain the confidentiality of your login credentials.
You are responsible for all activities under your account. Notify us immediately of unauthorized use.
Billing and Payment
Fees are billed per Fitzi.ai pricing guidelines. By subscribing, you authorize Growith to charge your selected payment method for all applicable fees.
All transactions are processed securely in accordance with PCI-DSS standards.
Refunds are only issued at Growith’s sole discretion and subject to evaluation.
Intellectual Property
All software, algorithms, AI models, branding, and content are the exclusive property of Growith LLC or its licensors.
Unauthorized use, reproduction, or distribution is strictly prohibited.
No Warranties / Limitation of Liability
Fitzi.ai Services are provided“as is” and “as available.”
We make no warranties—express or implied—regarding accuracy, reliability, or fitness for a particular purpose.
Growith is not liable for indirect, incidental, or consequential damages.
Any direct liability shall not exceed the amount you paid for Services within the past three (3) months.
Dispute Resolution
- Arbitration: Any disputes shall be resolved through binding arbitration under the Federal Arbitration Act.
- Class Action Waiver: Claims may only be brought individually, not as part of a class action.
Termination
Growith may suspend or terminate your access to Fitzi.ai at any time for violation of these Terms or misuse of the platform.
Governing Law
These Terms are governed by the laws of Texas, United States.
Exclusive jurisdiction lies with courts located in Dallas, Texas.
Modifications
We may update these Terms from time to time. Continued use after publication of changes signifies acceptance of the new Terms.
